RULES OF PARTICIPATION IN THE POZNAŃ BEER FAIR AND HEMPATHY EXPO 1. GENERAL PROVISIONS

1.1. The provisions of these regulations apply to all companies and entities (hereinafter referred to as Exhibitors) participating in the Poznań Beer Fair and Hempathy Expo on 15-16.11.2024 (hereinafter referred to as the Fair or Event), organized by Targi Piwne sp. z o. o., NIP: 779-246-37-93 with its registered office in Poznań, ul. Głogowska 31/33 (hereinafter referred to as the Organizer), represented by Grzegorz Stachurski.
1.2. Exhibitors are obliged to:
1.2.1. adapt to the thematic scope of the Fair,
1.2.2. comply with these Regulations,
1.2.3. compliance with the “Technical and fire protection regulations in force from 9 October 2023 on the premises of Międzynarodowe Targi Poznańskie Sp. z o.o.”, in particular fire protection regulations (point 11 of the regulations) and technical conditions for the execution of electrical, water and sewage installations and services (point 9 of the regulations).

2. THEMATIC SCOPE OF THE FAIR
2.1. The Fair may be attended by entities whose offer includes goods/services included in the list below: 2.1.1. beers and ciders,
2.1.2. meads, wines, craft vodkas
2.1.3. other craft products,
2.1.4. equipment, accessories and raw materials for home brewing and cider making and home production of other craft products,
2.1.5. equipment and raw materials for breweries,
2.1.6. catering equipment,
2.1.7. packaging, glassware and other promotional and advertising materials and services for the alcohol or hemp industry, 2.1.8. catering
2.1.9. products made from or using hemp
2.1.10 products and accessories enabling the use and storage of hemp products 2.1.11 equipment, seeds and cultivation of hemp
2.1.12 education, science and research on alcohol and hemp 2.1.13 consulting and services on alcohol and hemp
2.1.14 media, culture and social activism
2.1.15 accessories and gadgets related to alcohol and hemp 2.1.16 other companies related to alcohol and hemp
2.1.17 other companies related to craft products, entertainment activities and others matching the theme of the Fair
2.2. Entities conducting activities other than those listed in points 2.1 may apply to participate in the Fair as a partner or sponsor of the event.

3. RULES OF PARTICIPATION
3.1. APPLICATION FOR PARTICIPATION AND CONCLUSION OF A CONTRACT
3.1.1. Applications for participation in the Fair should be submitted by placing an order via the website https://b2b.targipiwne.pl/ or https://b2b.hempathyexpo.pl/ .

3.1.2. Applications for participation in the Fair will be accepted until the limit of available exhibition space is exhausted.

3.1.3. Placing an order is tantamount to submitting an offer to participate in the Fair and accepting all provisions described on the website and in these Rules of Participation.

3.1.4. Placing an order does not constitute confirmation of participation in the Fair. The Organizer will inform you about the acceptance of the placed order. 3.1.5. When registering, the Exhibitor has the right to choose the location of their stand based on the map provided by the Organizer, within the appropriate thematic zone. If the selected place has not been previously reserved, the Exhibitor has the right to reserve it.

3.1.6. The map will be made available on the website https://b2b.targipiwne.pl and will be updated at least every working day at the following times: 9:00 and 17:00. In special cases, the Organizer reserves the right to edit the map by changing the size of the surface, increasing or decreasing the number of stands and changing the location of individual stand numbers. 3.1.7. When reserving places, the order in which the applications are received is decisive. In a situation where it is impossible to assign the Exhibitor a stand number of their choice, the Organizer will contact them and present alternative proposals.

3.1.8. The application and reservation of a place are valid only if the applicant pays an advance to the Organizer’s account within 3 working days of completing the application. Account for advance payments: Targi Piwne sp. z o.o., account number: 33 1950 0001 2006 0025 1741 0002. In the transfer title, please enter: the name of the exhibitor being registered and the word “advance payment”.

3.1.9. Amount of advance payment:
a. For stands above 9m2: PLN 1,900 b. For stands below 9m2: PLN 1,000
3.1.10. The amount of the advance payment will then be included in full in the participation fee resulting from the order. An advance payment invoice will be issued for the paid amount of the advance payment.
3.1.11. The Exhibitor pays the fee for participation in the Fair in two installments:
a. The 1st installment is an advance payment, payable within 3 business days of sending the application,
b. The 2nd installment is the amount resulting from the order, reduced by the amount of the advance payment, payable by 18.10.2024 on the basis of the invoice received.

c. Failure to pay any of the installments on time (the payment date is the date the money is credited to the Organizer’s account) will be treated as withdrawal from participation in the Fair and will result in the cancellation of the space reservation and termination of the participation agreement at the initiative of the Exhibitor.
3.1.12. After qualifying the Exhibitor to participate in the Fair, the Organizer will send the agreement to the Exhibitor to the e-mail address indicated by him in the order via the platform for electronically signing documents and concluding online agreements.
3.1.13. Any changes to the space order and participation agreement must be made in writing or by e-mail under penalty of nullity.
3.1.14. The Organizer reserves the right to refuse to accept the application for participation in the Fair (in particular due to the inconsistency of the offer with the thematic scope of the Fair).
3.1.15. In the event of failure to qualify the applicant for participation in the Fair, the Organizer will immediately return the advance payment.
3.1.16. The participation fee in the Fair includes in particular:
a fee for the lease of commercial space and other services resulting from the Application Form,
promotion of the Fair,
general protection of the Fair provided by the Organizer,
medical coverage during the Fair,
waste removal according to specified rules.

3.2. WITHDRAWAL FROM PARTICIPATION IN THE FAIR

3.2.1. Withdrawal from the participation agreement must be in writing under penalty of nullity.

3.2.2. Exhibitors who withdrew from the participation agreement after paying the invoice, but by 30.09.2024, will be refunded the amount of payments made, reduced by the amount of the advance payment. The advance payment is a fee covering the Organizer’s costs related to servicing the Exhibitor until the Exhibitor withdraws from participation.

3.2.3. The Organizer will refund the amount referred to in point 3.2.2, within 30 days from the date of receipt of the letter or e-mail about withdrawal from the participation agreement.

3.2.4. In the event of withdrawal from the participation agreement in the Fair on 1 October 2024 or later, the Exhibitor shall not be entitled to a refund of previously paid fees.

3.3. TRADE FAIR SERVICES
3.3.1. Orders for services related to participation in the Fair should be placed by placing an order on the website: https://b2b.targipiwne.pl/ or https://b2b.hempathyexpo.pl/ . The prices and conditions of the offered services are specified on the order page.

3.3.2. The Exhibitor has the right to order paid forms of advertising specified in the offer.

3.3.3. The Organizer is not responsible for the content of advertisements provided for publication, as well as for the consequences of editorial errors.

3.3.4. In the event that the Exhibitor displays an advertisement with content that is contrary to applicable law or is offensive, scandalous or contrary to generally accepted principles of social coexistence, the Organizer has the right to remove such advertisements from the Fair grounds.
3.3.5. Advertising outside one’s own stand is subject to a fee and requires the written consent of the Organizer. Failure to provide such consent will result in the removal of such advertisements at the Exhibitor’s expense and risk.
3.3.6. Technical connections to stands: electrical, water and sewage, compressed air, telecommunications, as well as services related to suspending elements to the permanent structure of ceilings in pavilions and other services performed on the grounds of the Poznań International Fair (MTP) are performed exclusively by MTP. Based on orders from Exhibitors, the Organizer orders the above-mentioned connections from MTP for Exhibitors.
3.3.7. An Exhibitor who has alcoholic beverages in its sales offer is obliged to obtain the necessary licenses and permits. Applications for licenses can be submitted electronically via the website: https://www.biznes.gov.pl/pl/e-uslugi/00_0286_00 To streamline the work of the office, we recommend submitting applications no later than 18.10.2024. Submitting applications at a later date does not guarantee obtaining a license on time.

4. RULES OF CONDUCTING BUSINESS

4.1. An exhibitor who offers draft beer at the stand is obliged to allow visitors to purchase beer in tasting containers.

4.2. The exhibitor is obliged to have all the required documents authorizing the conduct of business activity in accordance with the regulations in force in this respect. The organizer requires the exhibitor to sign a declaration of possession of the relevant documents.

4.3. Trade in goods or services, the possession and offering of which is prohibited or restricted by law and applicable regulations, as well as the sale of goods and services that do not have PZH certificates, is prohibited.

4.4. The exhibitor undertakes to comply with the applicable regulations concerning the introduction of appropriately marked goods into trade, compliance with the expiration dates and durability of food products intended for sale.

4.5. The exhibitor offering food products is obliged to conduct business in accordance with the Act on the health conditions of food and nutrition (Journal of Laws 2006 No. 171 item 1225, as amended).

4.6. The Exhibitor is obliged to comply with the Act on Sobriety Education and Counteracting Alcoholism (Journal of Laws 2024, item 165, as amended), and in particular to respect the ban on selling alcohol to minors and intoxicated persons and the Act on Counteracting Drug Addiction (Journal of Laws of 2005, No. 179, item 1485), and in particular to respect the regulations on advertising and promotion of hemp products.

4.7. The Exhibitor is obliged to organize work and space in the stand area in accordance with the provisions of law in force on the day of the Event, guidelines of the Ministry of Development, Labor and Technology and the Chief Sanitary Inspectorate, in particular (if applicable) taking into account all restrictions, limitations, prohibitions and orders, as well as in accordance with sanitary recommendations.

5. ORDER REGULATIONS
5.1. The Exhibitor is obliged to comply with the order orders issued by the Organizer.

5.2. Entry to the Fair is permitted only for vehicles registered by the Exhibitor before the Fair and in possession of an entry card received from the Organizer, with the driver’s telephone number entered. Parking is permitted only in the zone designated by the Organizer.

5.3. Throughout the duration of the Fair, each vehicle on the premises of the Poznań International Fair must be marked with an entry card. Cars without an entry card with the driver’s telephone number and in the event that it is impossible to contact the driver may be towed away at the owner’s expense.

5.4. Detailed information on the hours of entry to the Fair will be sent to Exhibitors in due advance.

5.5. Dates and hours of opening of the Fair for visitors:
15.11, Friday, from 15:00 to 01:00
16.11, Saturday, from 16:00 to 12:00 – 01:00
5.6. Opening hours of the pavilions for Exhibitors and stand service:
15.11, Friday, 07:00 – 15:00 (assembly), 15:00 – 02:00
– Car access to the hall is possible on Friday until 10:30.
– Exhibitors are required to complete the dismantling of stands and large construction elements on Friday by 13:00 at the latest, in order to leave the passages free.
16.11, Saturday, 11:30 – 01:00
17.11, Sunday, 01:00 – 05:00 (dismantling)
– Exhibitors are required to complete the dismantling of stands and remove all stand elements from the hall by 05:00 on Sunday.
– Each additional hour of dismantling is payable separately by each Exhibitor remaining in the hall:
PLN 500 net for each hour from 05:00 to 05:59 on Sunday, November 17
PLN 1,500 net for each hour from 06:00 to 06:59 on Sunday, November 17
PLN 3,000 net for each hour from 07:00 on Sunday, November 17

Exceeding the dismantling hours will be confirmed on the “Protocol of exceeding the dismantling hours during the Expo” (Appendix No. 4 to the Agreement for Exhibitors), drawn up after the completion of the dismantling of the stand.
The Lessor reserves the right to claim compensation from the Lessee in an amount exceeding the amount of the contractual penalty.
5.7. Exhibitors are obliged to end sales at the stands at 01:00 on the night from Friday to Saturday and at 00:00 on the night from Saturday to Sunday. In the event of a breach of this provision by the stand staff, the Exhibitor undertakes to pay a contractual penalty of PLN 500 net, payable in cash at the time of the intervention of the Organizer’s representative at the stand. The basis for collecting a financial penalty from the stand staff will be the “Protocol of violation of sales hours during the Fair” (Appendix No. 5 to the Agreement for Exhibitors) drawn up by the Organizer’s representative in the presence of the stand staff and persons certifying the event. In the event of refusal to pay the contractual penalty, the Exhibitor undertakes to close the stand during the rest of the Fair, without refunding the stand fee.
5.8. During the opening hours of the Fair, stands should be accessible to visitors.
5.9. It is prohibited to display and present at stands an offer (goods and services) that is inconsistent with the thematic scope of the Fair. At the request of the Organizer, the Exhibitor should cease presenting such an offer.
5.10. Goods may not:
5.10.1. be displayed outside the stand,
5.10.2. be placed in the passageways adjacent to the stand,
5.10.3. be displayed in a way that makes it difficult for visitors to move around.
5.11. Advertising and promotional campaigns conducted outside the designated stand require prior agreement and written consent of the Organizer.
5.12. The Exhibitor undertakes to display the sales price on the goods sold.
5.13. Exhibitors / stand contractors are obliged to:
5.13.1. before the start of the Fair – remove packaging and waste remaining after the assembly and equipment of the stand from the stand and the surrounding area;
5.13.2. during the Fair – maintain the aesthetic appearance of the stand, the backstage area and their own gardens,

5.13.3. after the end of the Fair – to remove exhibits from the stand, dismantle the stand structure and equipment and restore the occupied exhibition space to its original condition.
Waste generated in connection with the assembly and dismantling of stands, as well as during the Fair, must be compressed and thrown into containers located in front of the entrances to the pavilion, subject to the ban on throwing away waste hazardous to health and the environment, referred to in point 12.3 of the “Technical and fire protection regulations in force from October 9, 2023 on the premises of Międzynarodowe Targi Poznańskie Sp. z o.o.”.
5.14. Removing goods from the stand and dismantling the stand before the end of the Fair is prohibited.
5.15. The activities described in point 5.13.3 may only be commenced after the Fair has been closed to visitors on the last day of the Fair.
5.16. In the event that the Exhibitor leaves elements of the stand casing and equipment on the premises of the Fair, and does not remove them during the dismantling period, the Organizer has the right to impose a financial penalty on the Exhibitor, covering the costs of removing the elements left behind.
5.17. Elements of the stand casing and equipment left without notifying the Organizer, and not removed by the Exhibitor during the dismantling period, are considered abandoned property.
5.18. During the Fair, the following are strictly prohibited:
5.18.1. using open fire,
5.18.2. using heating devices without supervision,
5.18.3. conducting commercial activities outside designated stands,
5.18.4. leaving rubbish, waste, dirt, etc.
5.18.5. selling or distributing products not approved for sale in Poland
5.19. It is prohibited to bring weapons, ammunition and explosives into the Fairgrounds, as well as items whose use may threaten the safety of persons present at the Fairgrounds.
5.20. It is prohibited to bring animals into the Fairgrounds.
5.21. It is prohibited to smoke tobacco products, as well as legal cannabis products, including e-cigarettes and vapes, outside designated areas throughout the Fairgrounds.
5.22. The Organizer reserves the right to temporarily or permanently close the Exhibitor’s stand if the Exhibitor fails to meet the conditions specified in these regulations, including in particular in the event of:
5.22.1. presenting and selling goods not declared in the Application Form, or not agreed with the Organizer,
5.22.2. not maintaining the aesthetic appearance of the stand and its facilities,
5.22.3. displaying goods outside the designated area,
5.22.4. conducting advertising and promotional campaigns not agreed with the Organizer.
5.23. Closing the stand by the Organizer in the cases referred to in point 5.22 may be temporary, i.e. until the Organizer’s order is carried out, or permanent, i.e. until the end of the Fair.
5.24. Permanent closing of the stand in the cases referred to in point 5.22 is treated as a sanction for the Exhibitor’s failure to fulfill the provisions of the participation agreement. In such a case, the Exhibitor shall not be entitled to a refund of the fees paid for participation in the Fair. The Exhibitor shall also not be entitled to compensation, as closing the stand constitutes a sanction for its culpable action.

6. SECURING THE AREA
6.1. The Fair grounds are secured by the Fair security services.
6.2. The Exhibitor is obliged, both during the Fair and during the periods of assembly and dismantling of the stand, and in particular in the event of temporary closure of the stand, to secure goods, equipment and devices against possible damage or losses at its own expense and risk.
6.3. During the Fair, the fair pavilion is opened, closed and sealed by a commission.
6.4. During the Fair, it is not possible to stay in the pavilion overnight. After the end of the Fair on the first day of the Fair, the pavilion will be closed and sealed by a commission. On the second day of the Fair, the pavilion will be opened by a commission one hour before the opening of the Fair to visitors.
6.5. The Exhibitor has the right to delegate its representative to the commission opening and closing the pavilions.
6.6. The Exhibitor is obliged to make all rooms available to the commission in order to check fire protection.

7. LEGAL LIABILITY
7.1. The Organizer shall not be liable for damage or loss to the property of the Exhibitors caused by third parties or solely due to the fault of the injured party.
7.2. The Organizer shall not be liable for damage to the property of the Exhibitors caused by force majeure, e.g. fire, explosion, lightning strike, gale, flooding or interruption in the supply of water or electricity beyond the control of the Organizer.
7.3. Exhibitors should take out their own civil liability insurance and insure their property located on the fairgrounds (exhibits, equipment and devices at the stand, elements of the stand construction and equipment, private property, company vehicles, etc.), both for the duration of the Fair and for the period of assembly and dismantling.
7.4. The Exhibitor shall be financially liable for causing damage to the property of MTP (damage, destruction, loss). This liability also applies to companies constructing stands. The damage is assessed by MTP in the presence of a representative of the Exhibitors or the stand contractor and the Organizer, which will be confirmed in an appropriate protocol.

7.5. Immediately notify the Organizer of any case of damage or failure occurring during the term of the Agreement, under penalty of the Exhibitor’s liability for damage caused to the Lessor. The Exhibitor is obliged to notify the Organizer and the fair police station in writing immediately after it is discovered.

7.6. The Exhibitor is obliged to conclude and maintain during the lease period civil liability insurance (OC) and accident insurance (NNW) caused by circumstances for which the LESSEE is responsible, with a minimum insurance sum of PLN 100,000.00 gross for each insurance, for damage caused to the Leased Object, other property of the LESSOR or personal injury.

8. COMPLAINTS
8.1. Any complaints from Exhibitors towards the Organizer should be submitted in writing.
8.2. Complaints from Exhibitors may be submitted up to and including the last day of the Fair.
8.3. Complaints will not be considered after the deadline specified above.

9. FINAL PROVISIONS
9.1. In the event of circumstances beyond its control, the Organizer reserves the right to cancel, partially close, shorten or postpone the date of the Event. In such cases, the Exhibitor shall not be entitled to compensation or reduction of fees for renting exhibition space.
9.2. The Exhibitor should respect the applicable provisions of the European Union community law and the provisions of the internal law of the Republic of Poland.
9.3. Any disputes that may arise from the participation in the Fair by Exhibitors shall be resolved by a competent common court in Poznań.
9.4. The text of these Regulations shall be deemed binding for the resolution of any disputes.
9.5. The law applicable to the interpretation of the provisions of the Regulations is Polish law.
